The rule
Section 320.03(8), Florida Statutes, says a license plate or revalidation sticker may not be issued to someone on the list kept for unpaid tolls, parking tickets, traffic fines or certain wrecker liens until their name no longer appears on it, or until they present a receipt from the governmental entity or clerk of court that provided the data showing the outstanding fines were paid.[1] For private tag agents, the same subsection says their authority to issue plates is revoked, after notice and a hearing, if they issue a plate or sticker contrary to it.[1]
The rule applies to annual renewals and to replacement registrations or plates. It does not apply to the transfer of a registration on a vehicle sold by a licensed dealer, except transfers that include an annual renewal, and it does not affect title issuance.[1] RS-37 says a title and original registration, or a transfer of an existing plate, may be processed, but an extension of the registration period on an existing plate can't be until the stop is satisfied or deleted.[2]
The counter procedure in RS-37
RS-37 is FLHSMV's procedure for tax collector employees and license plate agents processing and clearing parking ticket and toll violation stops.[2] In summary:
- The system shows a "Registration Stop" message. The renewal can't be processed without proof of payment for all fines.[2]
- The reporting agency is identified by the four-digit location code on the record. If it doesn't show, ask the customer which toll authority issued the invoice and direct them to the right authority. RS-37 Exhibit A lists SunPass at FDOT, CFX, THEA, LeeWay and the Miami-Dade Expressway Authority (MDX).[2] MDX is now the Greater Miami Expressway Agency (GMX).[3]
- The customer contacts the reporting agency and gets proof of payment.[2]
- The stop is either satisfied (proof of payment or verification of error) or deleted by the reporting agency.[2]
- When a tax collector office removes or satisfies a stop, the user creates a scan coversheet with the proof of payment or verification-of-error documentation and submits it with the Transaction Summary Report to be imaged.[2]
Follow your tax collector's instructions for your office. RS-37 is the state procedure, and individual offices publish their own receipt rules.
Where these cases stall
- Waiting on a fax. The Manatee County Tax Collector warns that customers often wait a long time for authorities to fax receipts, and that 30 minutes is not uncommon.[4]
- The release lag. FLHSMV says clearing can take one to three business days after the customer acts.[5] THEA asks for up to 72 hours.[6]
- Payment to the wrong place. A SunPass payment made after an account went to collections isn't applied to the collections amount.[7]
- Partial payment. CFX doesn't accept partial payments toward removing a hold.[8]
- Several holds on one record. Each needs its own proof. SunPass, for example, can't resolve other agencies' stops.[9]
How NotMyToll fits
NotMyToll helps tag agencies manage renewals stalled by unresolved toll holds. It organizes receipts and release documents, tracks each reported hold, and prepares the case for clerk review.
- Each reported hold gets its own record, with where the information came from and when it was checked. One paid invoice never closes a case with several holds.
- Receipts and release documents are read for issuer, account or invoice reference, payment date, amount, remaining balance and vehicle identifiers. Every field stays "extracted" until a clerk confirms it against the original.
- Each hold is matched to the toll authority that reported it and that authority's published contact. An evidence checklist records what your office accepts, from whom, through which channel, and when that procedure was last confirmed.
- The case comes back ready for clerk review, with a cover sheet on top of the original official documents. The cover sheet is not a release or a clearance certificate.
- A hold is recorded as cleared only when your clerk verifies it, with a date and a source.
The customer pays and requests documents through the authority's official channels. NotMyToll never takes payments, files disputes, chooses legal remedies or says anyone owes nothing. Disputed charges, wrong plates and court matters get a referral to the official process and status tracking only. See Lines we hold.
